Welcome to Makeup by Aleah. These Terms of Service govern your use of makeupbyaleah.com and, where applicable, services booked with Makeup by Aleah. By using this website, submitting an inquiry, or booking services, you agree to these Terms.

 

1. Services

 

Makeup by Aleah provides professional beauty services, including makeup application, bridal and wedding makeup, makeup lessons, mobile spray tanning, and other beauty services offered from time to time.

 

Services, pricing, and availability are subject to change. Pricing applicable to a confirmed booking will be based on the quote, proposal, or service agreement provided for that booking.

 

2. Bookings & Service Agreements

 

Appointments and event dates are subject to availability and are not considered confirmed until any required booking steps have been completed.

 

Certain services, including weddings and larger events, may require a separate signed service agreement. If a signed service agreement contains terms that differ from these Terms of Service, the signed service agreement will control for that booking.

 

3. Retainers & Payment

 

Certain bookings may require a retainer or other payment to reserve an appointment or event date.

 

Any applicable retainer, payment schedule, and payment terms will be disclosed before the booking is confirmed. 

Retainers may be non-refundable when disclosed as such at the time of booking or in the applicable service agreement.

 

Clients are responsible for payment of the services and applicable fees agreed upon at booking.

 

4. Cancellations, Rescheduling & Changes

 

Cancellation, rescheduling, and service-change policies may vary depending on the service booked. The policies provided at the time of booking or contained in a client's signed service agreement will apply to that booking.

 

Changes to a confirmed booking are subject to availability and may affect pricing.

 

5. Travel & Additional Fees

 

Mobile and on-location services may be subject to travel, parking, early-morning, or other reasonable service-related fees. Any applicable fees will be disclosed before the booking is confirmed or included in the client's quote, proposal, or service agreement.

 

6. Client Responsibilities

 

Clients are responsible for providing accurate information necessary to perform their requested services.

 

Before receiving services, clients should disclose known allergies, sensitivities, skin conditions, reactions to cosmetic or tanning products, or other conditions that may affect the safe performance of the service.

 

Clients receiving spray-tanning services are responsible for following preparation and aftercare instructions provided by Makeup by Aleah.

 

7. Health & Safety

 

Makeup by Aleah reserves the right to refuse, modify, or discontinue a service when reasonably necessary to protect the health or safety of the client, Makeup by Aleah, assistants, or others present. This may include unsafe or unsanitary conditions, severe or communicable illness, threatening or dangerous behavior, or requests to perform services under conditions the artist reasonably determines to be unsafe.

 

8. Results

 

Makeup by Aleah will provide services with reasonable care and professional skill. However, individual results may vary based on factors such as skin type and condition, allergies or sensitivities, preparation, aftercare, environmental conditions, and individual skin chemistry.

 

No particular cosmetic or spray-tanning result or duration is guaranteed.

 

Cosmetic spray-tanning products do not provide sun protection unless specifically stated by the product manufacturer.

 

9. Photography

 

Makeup by Aleah may request permission to photograph completed services for portfolio, website, social media, advertising, or other promotional purposes.

 

Identifiable client photographs will be used for promotional purposes only when appropriate permission has been obtained. Declining promotional use of photographs will not affect the services provided.

 

10. Website Content & Intellectual Property

 

Information provided on makeupbyaleah.com is for general informational and promotional purposes and is not medical or dermatological advice.

 

Unless otherwise stated, original website content, branding, service descriptions, graphics, and other materials are owned by or licensed to Makeup by Aleah and may not be reproduced or commercially used without permission except as permitted by law.

 

11. Third-Party Services

 

Makeup by Aleah may use third-party services for website hosting, inquiries, client management, contracts, scheduling, payments, analytics, and other business functions.

 

Your use of third-party websites or services may also be governed by those providers' own terms and privacy policies.

12. Limitation of Liability

 

To the fullest extent permitted by applicable law, Makeup by Aleah will not be responsible for indirect, incidental, special, or consequential damages arising from use of the website or services.

 

Nothing in these Terms is intended to waive or limit any right or remedy that cannot legally be waived or limited.

 

13. Circumstances Beyond Our Control

 

Makeup by Aleah will not be responsible for delays or inability to perform caused by circumstances reasonably outside its control, such as severe weather, emergencies, government restrictions, widespread illness, major transportation disruptions, or other circumstances making performance impossible or unsafe.

 

Any applicable refund, credit, rescheduling, or other obligations will be determined by the client's service agreement and applicable law.

 

14. Privacy

 

Personal information collected through makeupbyaleah.com or in connection with Makeup by Aleah services is handled in accordance with the Makeup by Aleah Privacy Policy.

 

15. Governing Law

 

These Terms are governed by the laws of the State of Minnesota, to the extent permitted by applicable law.

 

Nothing in these Terms limits consumer rights provided under applicable federal, state, or local law.

 

16. Changes to These Terms

 

Makeup by Aleah may update these Terms periodically to reflect changes in services, business practices, or legal requirements.

 

The current version will be posted on makeupbyaleah.com with an updated "Last Updated" date.

 

Changes to these website Terms will not override the terms of an existing signed service agreement.
